HOA Bylaws

The Greencrest Bylaws are the operating document of the Greencrest Homeowners Association. They are also the ruling document of the Greencrest Homeowners Association Board of Directors. Bylaws are the instructions from the Association’s membership to the Board concerning how to to conduct its business. They set forth the basic structure and abilities of the Board. They are normally kept basic in order to provide the Board with the latitude to pursue the interests of the organization. Bylaws are legal documents, and the inclusion requirements for them vary from state to state.

Unless specified in the Bylaws, Association meeting protocols, policies, and rules are subject to each Board’s review and adjustment as the Board sees necessary to meet current needs. Changes to the Bylaws require a majority vote of property owners present at a General Membership Meeting, either annual or special, as described in Article XIII. Membership Approval of Proposed Bylaws Updates at the Oct 2024 Annual Meeting

Gereencrest Homeowners Association is governed by the Colorado Revised Nonprofit Corporation Act, C.R.S. 7-121-101, etc. The Association has all rights, duties and powers permitted by the Nonprofit Act, “Unless otherwise provided in the bylaws” where allowed by the act.

The current GHOA Bylaws have not been updated since 2012 (2018 updated only Dues), and contain unnecessary restrictive provisions vs the current Nonprofit Act (e.g no proxies or voting by telecommunication, meeting notice only by USPS first class mail.) While there are other important updates needed to our current bylaws, updates to the three sections listed below are needed for efficient operation of the Association.
